General terms and conditions

1. Definitions and applicability

In these terms, "Contractor" means Kokluxa BV, Malden, Gelderland, The Netherlands, KVK 84729103, VAT NL84729103B01; and "Client" means the person or organisation requesting a quote or placing a booking. These terms apply to all quotes, bookings and agreements for catering and related services.

2. Quotes and prices

All prices on the website are per person in euros and include the applicable VAT rate (9% for food, 21% for services and drinks), unless stated otherwise. The calculator provides a calculation based on your choices. The agreement is concluded once the booking is confirmed and the deposit is received. For special requests (for example dietary requirements or unusual venues) we prepare a custom quote on request.

3. Booking and deposit

When booking, a deposit of 25% of the total amount is due via iDEAL. The remaining amount is due no later than the day of the event, unless agreed otherwise in writing. An invoice is available on request.

4. Changes

Changes to the number of guests or the menu can be sent by email up to 7 days before the event, subject to availability. The final number of guests is the basis for invoicing.

5. Cancellation

If the Client cancels, the following applies unless agreed otherwise in writing:

• more than 30 days before the event: the deposit is not refunded;
• 30 to 14 days before the event: 50% of the total amount is due;
• less than 14 days before the event: 100% of the total amount is due.

6. Right of withdrawal

For catering agreements for a fixed date there is no statutory right of withdrawal (art. 6:230p of the Dutch Civil Code).

7. Performance and force majeure

The Client provides access to the venue and the agreed facilities (such as space, power and water). In case of force majeure (such as staff illness, extreme weather or government measures) we will do our best to offer a suitable solution. We are not liable for damage caused by force majeure.

8. Allergies and dietary requirements

Report allergies and dietary requirements in writing in advance. Labels such as vegetarian, vegan, halal or gluten-free apply as stated with the package; cross-contamination can never be fully excluded.

9. Liability

Our liability is limited to the invoice amount of the booking concerned, except in case of intent or gross negligence.

10. Complaints

Report complaints in writing within 48 hours after the event via info@kokluxa.com. We respond within 14 days.

11. Governing law

Dutch law applies to all agreements. Disputes are submitted to the competent court in the district where the Contractor is established.
